General conditions of sale and purchase

Introduction

The publication of the products on our site constitutes an invitation to the customer to formulate a purchase proposal and this proposal will have contractual value, once formulated will result in full knowledge and acceptance of the conditions set out in the regulations set out herein following. The contract will be considered concluded with acceptance of the proposal by Allfoodproject.
Allfoodproject has the right not to accept the proposal without any duty to the customer who formulated it. The site offers products for sale both to users who can be defined as "final consumers" and to parties with VAT numbers.
The images of the multimedia catalog, together with the technical data sheet of the products, may not be fully representative of their characteristics, as the producers have the opportunity to implement improvements to the product at any time without prior notice.
The actual finishes of the variants indicated in the product sheets may differ slightly in shade due to the video settings used by the customer.

1. Company data

Products purchased on  www. Allfoodproject.com are sold directly by the company Allfoodproject duly registered with the register of companies in Palermo with VAT No. 03765550821 has its registered office and office in Via Maltese 62, 90146 Palermo (PA).

2. Acceptance of sales conditions and general terms

The contract stipulated between Allfoodproject and the Customer must be considered concluded with the acceptance of the order by Allfoodproject. This acceptance is considered tacit, if not otherwise communicated in any manner to the Customer after the verification of the order by Allfoodproject. By placing an order online, by telephone or e-mail, the Customer declares to have read and to accept in full the general conditions of sale and payment transcribed below.
The customer must keep these general conditions of sale (in compliance with the provisions of art.50 and ss of Legislative Decree 206/06) by printing a copy or saving it electronically.

3. Purchase procedure

The customer can purchase the products sold in the electronic catalog on the website www.Allfoodproject.com, as described in the related technical information sheets or in communications via email, also following contacts with Allfoodproject sales staff, who can send to the Customer custom quotes, including sales prices, payment methods, items in order of delivery address and corresponding VAT.
The receipt of the payment is confirmed by Allfoodproject by e-mail sent to the e-mail address communicated by the Customer. This confirmation message will include the order number, order date, billing information and recipient of the goods, details and prices including VAT of the goods ordered.
Only once received the payment from the Customer, Allfoodproject will start the phases relative to the production / shipment of the goods.
Any notice of non-acceptance of the order due to unavailability of the product and / or longer delivery times to those indicated in the quotation / product sheet, will be promptly communicated to the customer, by phone or by e-mail. In such cases, the Customer may, alternatively, change the product, wait for availability in the new times communicated or cancel the order requesting a refund for any sum already paid.
Any right of the Customer to compensation for damages is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or property, caused by the non-acceptance, even partial, of an order.
Any changes to orders already confirmed can not be guaranteed and will eventually be authorized by Allforfood Srl on the basis of the state of progress of production.

4. Shipments and deliveries

Purchases made on www.Allfoodproject.com are delivered, via national and international couriers, to the delivery address indicated at the time of ordering.
During the order process carried out, Allfoodproject issues a suitable document to accompany the material shipped (Transport Document) while the invoice will be sent to the e-mail address previously communicated by the Customer. For the issuance of these documents, the information provided by the Customer at the time of ordering shall prevail. After the invoice has been issued, it will not be possible to make changes to it.
Shipping costs less than Euro are calculated based on the weight of the goods and at the destination. the estimate is without obligation and does not involve the conclusion of the order, if not after the confirmation of the same and the successful transmission by Allfoodproject of production orders to its suppliers.
The Customer can communicate any detail he deems necessary so that the courier can reach the place of delivery, reporting in the order notes or through an e-mail to info@Allfoodproject.com before shipping the goods from the manufacturers' warehouses.
To facilitate the delivery, Allfoodproject ncludes for free the order of telephone notice by the courier. With this service, the customer is contacted by telephone by the courier to determine the day and time of delivery. It is therefore advisable to enter a telephone number where it is always available.
The telephone notice must be understood as the possibility of agreeing with the carrier the delivery within 48 hours from the notice. Any costs of storage, due to deliveries beyond the previously indicated terms (48 hours from the telephone notice) or repeated failure of the customer to contact attempts made by the courier to arrange delivery, will be fully charged to the customer. Standard delivery is carried out on the street level. The national and international couriers make deliveries from Monday to Friday, in normal working hours regulated and indicated by them and can not be syndicated by Allfoodproject. No responsibility can be charged to Allfoodproject due to delivery delays attributable to the appointed carrier.



The products are packed with resistant materials and suitable to ensure optimal protection during transport.
In case of receipt of goods that present obvious tampering and / or breakage of the packaging, the customer must accept the goods with "CONTROL RESERVE", describing personally and in detail the damage on all copies of the courier delivery notes.
Having verified the presence of damage caused by transport, the customer is obliged to report it to Allfoodproject within 5 (five) days of receipt of the goods by e-mail or the section "Restruct article", complete with photographic documentation of the packaging and damaged goods .
The customer who for any reason will not have followed the above mentioned indications of this contract will not be able to subsequently reclaim any shortages or damages caused by the carrier.

5. Delivery times

Allfoodproject undertakes to respect the times indicated in the estimate, trying to anticipate them.
In each product and estimate sheet, the times for delivery to the goods at destination are reported, but they must not be considered by the Customer as binding for the conclusion of the contract stipulated with Allfoodproject.
Delivery times can be checked at any time by the Customer with Allfoodproject operators by telephone or e-mail.
Any advances or delays in delivery times indicated in the product sheet, in a quotation or provided by e-mail or telephone not identifiable at the time of order, but only during the preparation or production phases of the same, will be communicated promptly as soon as the same Allfoodproject will be aware of it. In any case, they can not be considered by the customer for claims for damages or compensation as well as any contractual or extra-contractual liability for direct or indirect damage to persons and / or property.

6. Payment method

The prices shown on the product sheet of items that can be ordered online or quoted and the relative transport costs are always VAT excluded.
Following the purchase process, the customer can select the following payment methods:

a. Credit card: in case of purchase of goods with a credit card payment method, the credit card is debited at the conclusion of the online transaction. Allfoodproject reserves the right to ask the customer for additional information, such as identification documents and / or proof of ownership of the credit card used. In the absence of the required documentation, Allfoodproject reserves the right not to accept the order.

 

b. PayPal: PayPal is one of the most used payment systems in the world. By choosing this mode you can make the payment through your personal PayPal account simultaneously with the conclusion of the transaction.


c. Facilitated financing is the payment method that allows you to obtain instant financing with our partner consel. Any notice of non-acceptance of the loan will be communicated promptly to the customer, by telephone or by e-mail. In such cases, the Customer may, alternatively, change the payment method, or wait for the availability of new possible loans designed for his needs.

d. Advance bank transfer: the method of payment by bank transfer anticipates the acceptance and validity of the order, only after the payment by the Customer and unequivocal receipt by Allforfood Srl of the bank transfer. The data to perform the transfer are communicated on the order confirmation page at the end of the online procedure or in the estimate sent to the customer. The purpose of the transfer must include the order number, name and surname of the person in charge of the order and a copy of the accountant must be sent by e-mail to info@Allfoodproject.it

7. Withdrawal notice

In the presence of a final customer-consumer ( private person) the right of withdrawal can be exercised according to current legislation.
To exercise this right, the Customer, within 14 working days from the date of receipt of the merchandise, must send to Allfoodproject a communication by registered letter with an acknowledgment of receipt in advance by e-mail to info@Allfoodproject.com declaring to take advantage of the right of withdrawal and indicating the order number, the invoice number, code and quantity of the items, if the withdrawal is partial (only in case of purchase of several items) or total and the bank details to obtain the bank transfer ( Iban code of the invoice holder).
The goods must be returned intact in the original packaging properly sealed, complete in all its parts (including packaging, internal protections, external protection, wooden pallets and any documentation and accessory equipment: manuals, assembly equipment, etc.) at the address indicated from Allfoodproject by courier appointed by the Customer.
The shipping costs related to the return of the asset are charged to the customer.
After verifying the integrity of the goods, Allfoodproject will proceed within 30 days from the return of the value of the product / s by retaining only the amount of shipping costs, additional services and any costs incurred for the delivery of the goods at the Customer and indicated in the accompanying invoice.
The right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product.
The shipment for the return of the material, until the confirmation of receipt in our warehouse, is under the full responsibility of the customer.
In case of damage to the goods during the return transport, Allfoodproject will inform the customer of the event (within 5 working days from receipt of the goods), to allow him to promptly report his complaint to the courier chosen by him and obtain a refund of the value of the asset (if insured); in this case the product will be made available to the customer for his return and at the same time the request for withdrawal and then reimbursement will be canceled.
Allfoodproject is not responsible in any way for damage or theft / loss of goods returned by shipments not insured by the Customer.
The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the property, in the cases in which Allfoodproject ascertains:

a. damage to the product for reasons other than transport.

b. the lack of the external packaging and / or the original internal packaging;

c. the absence of integral elements of the product;

d. the non-diligent use of the good that has compromised the integrity or use of any consumables;

In the event of forfeiture of the right of withdrawal, the goods shall remain at the Customer's disposal for collection at his expense.
The right of withdrawal CANNOT be exercised in the case of purchases of customized products according to the indications requested by the Client and for which finishes of sample colors or fabrics chosen or sent by the same have been made. Products outside the European community cannot be returned.

Moreover, Allfoodproject is NOT responsible for any problems caused by unforeseeable external variables such as machine malfunction or inadequate technical assistance.



8. Guarantees

The products sold by Allfoodproject are covered by warranty pursuant to Legislative Decree 206/06. In case of purchase made by a subject that can be defined as "final consumer" (private individual) the warranty is valid for 24 months and covers defects of product conformity. In all other cases the conventional warranty is 12 months.
Pursuant to Legislative Decree 206/05, the warranty applies to the product that presents a lack of conformity, provided that the product has been used correctly in accordance with its intended use. In the event of a lack of conformity, Allfoodproject will, at no cost to the Customer, send the parts necessary to restore the conformity of the product.
The Customer is required to check the goods and their operation within 5 days of delivery. Any defects already present at the delivery of the material must be communicated to Allfoodprojectentro 5 days from receipt of the same by e-mail to info@Allfoodproject.it indicating the code of the article, details and photographs of the defect found.
In the event that Allfoodproject is not able to provide the Customer with a product under warranty (restoration or replacement), the same may proceed to its replacement with a consensual product of similar characteristics or higher than the one disputed or to return the amount paid taking account of the use of the good.
In case of warranty replacement, Allfoodproject will collect the defective material for the actual verification of defects claimed by the customer. The withdrawal will be agreed with the customer date and time slot.
The goods under warranty must be returned by the customer in the original packaging properly sealed, complete in all its parts.
Allfoodproject will take care of the organization of the transport of return and return substitutive / repaired goods under warranty, but the transport will still be borne by the Customer.
The customer is required to keep the original packaging and all additional documentation of the products purchased until the expiry of the warranty terms of the product.

Allfoodproject does not guarantee damages caused by incorrect use of the article.

If there is evident damage to the packaging when the goods are unloaded:

EXPRESS A RESERVE: the package is accepted but before signing the document the customer must affix the words "I accept with reserve right", specifying as far as possible the damage found. Once the package has been opened and the damage assessed, it will be possible to compensate in the shortest possible time.

DAMAGE THE DAMAGED GOODS: if it is not possible to accept the package with reserve or in case the damage is still visible without having to open the package.

In any case, the Customer is required to report the damage within 5 days of delivery. Otherwise Allfoodproject will not be liable for any damages.

The Customer is obliged to keep a copy of these "general conditions of sale and purchase" in paper or electronic form valid at the time of signing the distance contract (receipt of customer order).
